Allowing the New Laws to Work in Your Favor

In October 2008, Florida custody laws changed to incorporate parenting plans. These plans were created in an effort to keep people out of court in the future, which can lessen court costs and disputes between parents. The plans cover a variety of issues, including meeting and dropping off places, visitation schedules and different types of care for the child.

Prior to this law, courts followed the general pattern of having the child stay with one parent during the week and visiting with the other parent every other weekend. There is now solid foundation that shows it is better to have the two parents share time more evenly with the child. Keeping an Eye on the Best Interests of Your Child

The courts determine custody and parenting plans using the standard of the best interests of the child. This usually means that the parents follow a time sharing plan that equates to shared custody. In shared custody situations, instead of sole legal custody and sole physical custody, both parents have an equal say in the raising of their child, including decision-making about religion, school, medical care and where the child will live.

There are situations, however, when shared parental responsibility is not in the best interests of the child.
