What Are Prenuptial and Postnuptial Agreements?

A prenuptial agreement, also referred to as a premarital agreement, is a legal document signed by both parties planning to marry. This contract establishes what happens to a person's income and assets in the event of divorce or death. In Florida, a prenuptial agreement must be executed at least 30 days before a wedding to reduce the possibility of duress.

A postnuptial agreement, on the other hand, is signed after the wedding takes place. It addresses the same issues as a prenuptial agreement, but there is no time limit governing when this contract must be executed.

It is a common misconception that only the very wealthy get prenuptial agreements. In reality, anyone who wishes to protect certain assets has reason for one. You might consider this contract if:
